Criminal Defense for Controlled Substance Charges in Manassas, VA

A drug possession charge can feel overwhelming, but it isn’t a conviction. You have the right to defend yourself, and the outcome often depends on decisions made in the first days after an arrest. At Wright Law Group PLLC, our Manassas criminal defense attorneys review the full circumstances of your charge, starting with the search that led to it, to build a defense based on what actually happened.

If you’re facing a drug possession charge in Manassas, don’t wait. Call us at (703) 420-7011 for a free consultation. A defense can start before charges are formally filed.

Direct Attorney Access When It Matters Most

When you retain a lawyer at Wright Law Group PLLC, your case stays with your managing attorney. We don’t hand files off to paralegals or support staff once you’ve signed on. The person who knows your case is the person you speak with, appear with in court, and hear from when something changes.

As a boutique firm, we dedicate our full attention to each client, and you’re backed by an entire team of legal professionals, not a single attorney working in isolation. Our criminal defense attorneys include a former prosecutor and a judicial law clerk, backgrounds that give us a practical understanding of how the Commonwealth builds its cases and how courts evaluate evidence.

What Virginia Law Says About Drug Possession

Virginia Code 18.2-250 makes it unlawful to possess a controlled substance without a valid prescription. “Possession” covers more than what’s on your person. Drugs found in your car, your home, or otherwise within your control can support a charge.

The law distinguishes between two types of possession. Actual possession means the substance was on your body. Constructive possession applies when drugs are found nearby, but it requires the Commonwealth to prove you knew the substance was there and had the ability and intent to exercise control over it. That distinction is often where a defense begins.

Penalty tiers under Virginia law are tied to the drug’s schedule:

  • Schedule I or II controlled substance: Class 5 felony, punishable by up to 10 years in prison and a fine of up to $2,500
  • Schedule III controlled substance: Class 1 misdemeanor, punishable by up to 12 months in jail and a fine of up to $2,500
  • Schedule IV controlled substance: Class 2 misdemeanor, punishable by up to 6 months in jail and a fine of up to $1,000

The consequences don’t stop at sentencing. A drug conviction can cost you your current job, narrow future employment options, and create restrictions on housing.

How We Build a Drug Possession Defense

Most drug possession charges follow a police search: a traffic stop, a frisk on the street, or a search of a home following a complaint about drug activity. Police must follow constitutional rules in every one of those situations. When they don’t, evidence obtained from an unlawful search can be excluded, and without that evidence, the Commonwealth’s case may not survive.

Even when a search was lawful, the government must still prove you knowingly and intentionally possessed the controlled substance. Proximity alone isn’t enough. If the substance was legitimately prescribed to you, that’s a recognized defense under the statute. As your drug possession attorneys, our job is to identify every point where the Commonwealth’s case falls short and press those points aggressively.

Virginia’s First Offender Program Under Code 18.2-251

For eligible individuals facing a first possession charge, Virginia offers a deferred disposition path under Code 18.2-251. Rather than entering a judgment of guilt, the court places the defendant on probation. Conditions typically include a substance abuse assessment, treatment or education programming, drug and alcohol testing, efforts to maintain employment, and community service of at least 100 hours for a felony charge or up to 24 hours for a misdemeanor.

Complete the terms successfully, and the charge can be dismissed without a conviction on your record. Eligibility generally requires no prior conviction for a similar offense and no prior dismissal under this same program. The program isn’t available for distribution charges or possession with intent to distribute. Whether you qualify, and whether pursuing it serves your interests, is exactly the kind of decision we help clients make with full information.
